MLC 2006 (Maritime Labour Convention) ek international treaty hai jise India ne ratify kiya hai. Yeh seafarers ke basic rights guarantee karta hai:
- Reasonable working hours aur rest periods
- Safe working conditions
- Freedom from harassment aur bullying
- Dignity aur respect at workplace
- Access to complaint mechanism onboard aur ashore
Yeh sirf kagaz par nahi hai. Port State Control officers ships par inspect karte hain. Companies ko MLC compliance maintain karni padti hai ya vessels ko port se detention ho sakti hai.
Kya Karein Jab Bullying Ho
Step 1: Document Everything
Date, time, kya hua, kaun witness tha — likh rakho. Phone ke notes mein, personal diary mein. Yeh documentation baad mein zaroori hoti hai.
Step 2: Designated Person Ashore (DPA) Se Contact Karein
Har ISM-compliant company ka ek DPA (Designated Person Ashore) hota hai — yeh woh person hai jo safety aur welfare concerns ke liye contact point hai. DPA ka contact number ship ke SMS (Safety Management System) documents mein hota hai.
Email ya written message (WhatsApp bhi acceptable hai as documentation) bhejein:
- Kya hua
- Kab hua
- Witnesses kaun the
- Aap kya resolution chahte hain
Step 3: Master Se Formal Complaint
Agar DPA unreachable hai ya Master khud involved nahi hai — Master ko formal written complaint dein. Ship’s log mein request karein ki complaint record ho.
Agar Master hi problem hai:
DPA se direct contact karein. Master ko bypass karna is situation mein legally appropriate hai.

Step 5: Port Mein Escalation
Jab ship kisi port par aaye — PSC (Port State Control) officer se mil saktein hain. Unhe MLC 2006 ke under complaint file kar saktein hain. Yeh formal inspection trigger kar sakta hai.
Kya Complaint Se Contract Cancel Ho Sakta Hai?
Legitimate complaint file karna legal protection deta hai — lekin practically, retaliation ho sakti hai. Isliye:
- Complaint written ho — verbal nahi
- DPA aur ITF ko simultaneously bhejein — company ko akele cover-up ka chance mat do
- Saare documents apne paas rakhein — company ko original mat do
Agar retaliation ho (early discharge without valid reason), yeh wrongful termination hai aur separately claimable hai.
